5:41 pm
willis insists her relationship with that prosecutor, nathan wade, "does not amount to a disqualifying conflict of interest" requiring her to recuse herself. trump and two of his co-defendants have accused willis of improperly benefiting from hiring wade, who has been paid $650,000 over two years. >> the district attorney is totally compromised. the case has to be dropped. >> reporter: in church last month, willis suggested wade was only under scrutiny because he's black. >> i appointed three special counselors. it's my right to do. paid them all the same hourly rate. they only attack one. >> reporter: but at the time, willis did not acknowledge their romance. today she did. her court filing included an affidavit from wade confirming they "developed a personal relationship" in 2022 after he was hired. trump and his two co-defendants claim willis benefited from the money her office paid wade, saying he had taken her on lavish vacations. but today wade insisting, "the district attorney received no funds or personal financial gain from my position as special prosecutor."
5:42 pm
david, the big question, what happens if the district attorney is somehow disqualified? well, a state prosecutor's agency would likely assign the case to a different d.a., who may or may not go forward. so far, there's no sense that's going to happen and no sign fani willis will recuse herself on her own. david? >> david: so many questions remain, aaron, thank you. there is news in the federal case involving donald trump as well. a federal judge formally postponing his election interference and january 6th case, originally scheduled for march. judge tanya chutkan saying she won't set a new date until an appeals court weighs in on trump's claim of presidential immunity. jury selection was set to begin next week. next tonight here, to michigan, where closing arguments have ended in the trial against jennifer crumbley. her fate soon in the hands of the jury. trevor ault in michigan again tonight. >> reporter: tonight, the fate of the first parent on trial for their child's deadly school shooting will soon be in the
5:43 pm
hands of a jury. jennifer crumbley, charged with those four unprecedented counts of involuntary manslaughter, the prosecution claiming she was too wrapped up in her own hobbies and extramarital affairs to pay attention to her son's cries for help. >> she has done the unthinkable, and because of that, four kids have died. >> reporter: in their closing argument, prosecutors telling the jury, this case is about what crumbley knew and did not do. >> she walked out of that school when just the smallest, smallest of things could have saved, could have helped hanna and tate and madison and justin. >> the first thing i want to do -- >> reporter: crumbley's defense attorney, countering, claiming the prosecution "cherrypicked" evidence to turn the jury against her, slamming piles of pages on the podium. >> you don't have to like her. it's important to set aside your opinions of her. >> reporter: the defense arguing this case is "very dangerous" for parents in this country, saying crumbley was a
5:44 pm
"hypervigilant mother" but her son was "a skilled manipulator." >> at this point in the trial, i am asking that you find jennifer crumbley not guilty, not just for jennifer crumbley, but for every mother who's out there doing the best they can, who could easily be in her shoes. >> reporter: and david, the jury will be back here monday morning. they'll be given instructions on the charges, then they'll deliberate. david? >> david: trevor ault in michigan again tonight, thanks, trevor. we're going to turn now to the crisis at the border now. and after months of republicans demanding that president biden do something, senators from both parties, republicans and democrats, signaling tonight they have reached a bipartisan deal, the first time in many years. but will the house even consider it, or ignore it, as donald trump has asked? rachel scott live on the hill tonight. rachel, when will we see what's in this potential solution, this bill, and will presidential politics outweigh what appears to be a significant step toward some sort of a bipartisan
5:45 pm
solution, finally? >> reporter: david, it certainly could. we are learning that for the first time in over a decade, democrats and republicans in the senate have reached a deal on border security and immigration. we are told this package also includes additional funding for both israel and ukraine. the final details still being negotiated, but we could see the legislation as early as this weekend. the senate does want to move quickly on this, with votes expected next week. but it does face major challenges ahead in the house. donald trump wants to run on the issue of immigration in november, has been urging republicans to reject this compromise before they even have a chance to read the final details of the bill. so tonight, the senate republicans leading these talks, they are urging colleagues to wait to read the details before they decide how they will vote. >> david: rachel scott. we'll see you on the hill next week. thanks, rachel. we turn now to the economy and the jobs market revving up. the eye-opening numbers tonight. employers adding 353,000 jobs last month, much higher than expected. unemployment unchanged at 3.7%.
5:46 pm
the markets today soaring on the news. the dow reaching its ninth record high since just the beginning of this year. whit johnson tonight on these new numbers. >> reporter: tonight, the american job market is surging, adding 353,000 jobs in january, nearly doubling what economists had predicted. the blockbuster report comes on the heels of the 333,000 jobs added in december and stronger than expected economic growth to end 2023, reversing earlier fears of a possible recession. stunning numbers, despite some recent high-profile layoff announcements from companies like ups, google, and amazon. and workers are making more money. wages jumped 4.5% year over year, outpacing inflation. the news sent stocks soaring. the dow and the s&p 500 both hitting record highs again. it comes after the federal reserve decided this week to leave interest rates unchanged. and it could further delay plans to cut rates later this year amid fears that inflation could
5:47 pm
rise again. chairman jerome powell signaling he has faith in the current durability and strength of the entire american economy. >> it's a good labor market. and we've seen inflation come down. this is a good situation. let's be honest. this is a good economy. >> reporter: and david, the unemployment rate held steady at 3.7%. that's now two years in a row below 4%, the longest streak of its kind since the 1960s. david? >> david: all right, whit johnson, we'll see you tomorrow night in this chair. thanks, whit. when we come back here, the chilling new details tonight. the son who allegedly killed, beheaded his own father, a longtime federal worker. authorities pointing to rage over the government. what that son allegedly did the day before. also quaker oats in this major recall. and remembering a beloved actor from "rocky" to "the mandalorian." for possibilities, has you searching discover a different first treatment. immunotherapies work with your immune system to attack cancer. but opdivo plus yervoy is the first combination of 2 immunotherapies for adults newly diagnosed with non-small cell lung cancer
